1. OVERVIEW

These Terms & Conditions ("Terms") govern your use of Blue Quill Digital Solution ("Blue Quill Digital Solution", "we", "our", or "us") and the services we provide, including website design and development, branding, logo design, digital marketing, SEO, and related creative services. By placing an order, submitting a form, or otherwise engaging our services, you agree to be bound by these Terms. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (ACL) that cannot lawfully be excluded, restricted, or modified.

2. SERVICES & PACKAGES

Service inclusions, deliverables, turnaround times, and pricing are as described on our Packages and Combo Packages pages at the time of order, unless otherwise agreed in writing. Any add-ons, additional pages, or scope beyond what is listed in a package may incur additional charges, which will be communicated to you before work begins.

3. PAYMENTS

Full or partial payment (as specified at checkout) is required before work commences on your project, unless a different payment arrangement has been agreed in writing. Prices listed on our website are subject to change without notice, though confirmed orders will honor the price agreed at the time of purchase.

4. REVISIONS

The number of revision rounds included with your order depends on the specific package purchased, as described on the relevant package or order page. Requests that materially change the original project scope or brief may be treated as a new revision round or an additional service.

5. OWNERSHIP & INTELLECTUAL PROPERTY

Where a package includes "100% Ownership Rights," full ownership of the final approved deliverables transfers to you upon full payment. Until full payment is received, all designs, code, and materials produced remain the property of Blue Quill Digital Solution. Preliminary concepts, drafts, and any materials not selected as the final deliverable remain the property of Blue Quill Digital Solution and may not be used without permission.

6. CONSUMER GUARANTEES & REFUNDS

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure in our services, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services re-supplied or, at our discretion, refunded if the services fail to be of acceptable quality and the failure does not amount to a major failure.

Where a package additionally includes a specific money-back guarantee, the eligibility, timeframe, and conditions of that guarantee are as described on the relevant package or order page, in addition to (not instead of) your rights under the Australian Consumer Law.

7. TURNAROUND TIMES

Estimated delivery times listed on our packages are approximate and depend on timely feedback, content, and materials being provided by you. Delays in providing requested information or approvals may extend the estimated turnaround time.

8. LIMITATION OF LIABILITY

To the extent permitted by law, and subject to your non-excludable rights under the Australian Consumer Law, Blue Quill Digital Solution shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services or website. Where permitted under the ACL, our liability for a failure to comply with a consumer guarantee is limited, at our option, to the resupply of the services or the cost of having the services resupplied.

9. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

10. CHANGES TO THESE TERMS

Blue Quill Digital Solution may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
